These Terms of Service ("Terms") govern your use of oumislegacy.com, shop.oumislegacy.com, and related services, content, purchases, and booking requests (together, the "Site"). By using the Site, placing an order, or submitting a booking request, you agree to these Terms and to any additional policy or offer-specific terms that apply.

1. About Oumi's Legacy

Oumi's Legacy is a family culinary venture based in Lexington, Kentucky, offering Moroccan pastries, prepared meals, culinary experiences, and related services. Oumi's Legacy, LLC. Our offers may include Oumi's Delights, Oumi's Flavors, Oumi's Private Chef, Oumi's Atelier, Oumi's Catering, and others introduced over time. Availability may vary.

2. Eligibility

By placing an order or submitting a booking request, you confirm you have the legal capacity to enter into the transaction, or are acting with the involvement/authorization of a parent, guardian, or other person legally able to do so where required; that your information is accurate and complete; and that you're authorized to use the payment method submitted. Specific offers may have their own participant-age or eligibility requirements, stated in their applicable terms.

3. How Our Policies and Terms Fit Together

These Terms are the general umbrella for the Site. Specific topics are governed by their own policies or offer-specific terms:

Where these general Terms conflict with a more specific policy or offer-specific terms, the more specific terms apply, except where applicable law requires otherwise.

4. Products and Services

We make reasonable efforts to describe our products and services accurately. Because many food products are handmade or prepared in small batches, there may be reasonable variation in appearance, size, shape, color, garnish, presentation, and packaging. Photographs represent products as accurately as reasonably possible but don't guarantee exact appearance. Products and services are subject to availability.

5. Order and Booking Acceptance

Submitting an order, inquiry, or booking request doesn't always mean it's accepted or confirmed. We may review, decline, cancel, or limit an order or booking where reasonably necessary — unavailability, capacity reached, payment can't be authorized, an obvious pricing/listing error, fulfillment isn't reasonably possible, or reasonable suspicion of fraud or misuse. Where payment was already collected for a cancelled order, refunds follow the Return & Refund Policy or relevant offer-specific terms. Confirmation processes for Private Chef, Atelier, and Catering are governed by their own Booking Details & Terms.

6. Prices and Payment

Prices are shown in USD unless stated otherwise and may change from time to time. The price at order submission normally applies, except for an obvious pricing error, a custom quote/proposal, or additional charges disclosed and accepted before confirmation. Applicable taxes or fees may be added and shown before payment where required. Payment is processed through Shopify or other methods available at checkout.

7. Customer Information and Responsibilities

You're responsible for accurate, complete information relevant to your order or booking — contact details, pickup/delivery information, event address, guest count, allergies or dietary requirements, access/logistical information, and anything else reasonably required to fulfill the order. We're not responsible for problems caused by materially inaccurate, incomplete, or late information you supply, except where the law provides otherwise.

8. Food and Allergen Information

Our food-preparation environments may handle common allergens and are not allergen-free unless expressly stated. You're responsible for reviewing available allergen information and disclosing relevant needs where requested. Specific rules on allergens, storage, handling, and refunds are governed by the relevant product information, Return & Refund Policy, or applicable Booking Details & Terms.

9. Changes to Orders or Bookings

Change requests are subject to availability, applicable cutoffs/deadlines, and the specific terms governing that offer. We'll make reasonable efforts to accommodate changes but can't guarantee this past an applicable cutoff, confirmation deadline, or preparation stage. Additional charges may apply where a change increases scope or cost.

10. Returns, Refunds and Cancellations

Governed by the Return & Refund Policy and, where applicable, the relevant offer's Booking Details & Terms. Not restated here.

11. Intellectual Property

Unless otherwise stated, Oumi's Legacy owns or is authorized to use the original business content created for the Site and related activities — brand names and logos, website text, photographs, graphics, product descriptions, documents, and workshop materials created specifically for Oumi's Legacy. This may not be copied, reproduced, or commercially exploited without prior permission, except where permitted by law.

Oumi's Culinary Heritage. Oumi's pre-existing recipes, techniques, gestures, stories, know-how, traditions, and culinary knowledge remain part of her personal and family culinary heritage. Nothing in these Terms, and no purchase or participation in an Oumi's Legacy product or experience, transfers ownership of that pre-existing heritage to a customer or changes its underlying ownership. Materials specifically provided through Oumi's Atelier are additionally governed by that offer's own intellectual-property provisions.

12. Acceptable Use

You agree not to provide materially false or misleading information, use the Site unlawfully, interfere with its security or operation, attempt unauthorized access, place fraudulent orders, misuse promotions or booking processes, harass our team or other participants, or commercially reproduce Site content without permission. We may restrict use or decline transactions where reasonably necessary to address fraud, abuse, safety concerns, or unlawful activity.

13. Reviews, Feedback and Submitted Content

If you voluntarily provide a review, comment, or other non-confidential feedback, we may use it for reasonable business purposes, including improving and describing our products and services. You confirm any material you submit is yours or that you have the right to provide it.

Submitting a photograph, participating in an experience, or appearing in content does not automatically grant Oumi's Legacy permission to use your identifiable image for promotional purposes where separate consent is required. Specific photography/media-consent provisions for an experience are governed by that offer's own terms.

14. Third-Party Services

The Site relies on third-party providers for e-commerce, payment processing, hosting, communications, forms, mapping, and delivery. Your use of certain third-party services may also be subject to their own terms. Personal-data handling involving third parties is described in our Privacy Policy.

15. External Links

The Site may link to third-party websites for convenience; this doesn't imply endorsement, and we're not responsible for third-party content, availability, or policies beyond what the law requires.

16. Website Availability

We aim to keep the Site available and accurate but don't guarantee uninterrupted, error-free operation — occasional unavailability due to maintenance, technical issues, third-party outages, or circumstances beyond our reasonable control may occur. Nothing here affects rights relating to products or services that cannot legally be excluded.

17. Errors and Inaccuracies

The Site may occasionally contain typographical errors, inaccurate descriptions, or pricing mistakes. We may correct these when discovered. If an error materially affects an order already placed, we may contact you and, where necessary, cancel or amend it; any refund follows the relevant policy or offer-specific terms.

18. Circumstances Beyond Our Reasonable Control

We're not responsible for failure or delay caused by circumstances beyond our reasonable control — severe weather, illness, emergencies, transportation disruption, venue closure, utility failure, government restrictions, or significant supply disruption. Any resulting cancellation, rescheduling, or refund is handled under the applicable policy or offer-specific terms.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or consumer right that cannot legally be excluded. To the extent permitted by law, Oumi's Legacy is not responsible for indirect or consequential losses that were not reasonably foreseeable.

20. Privacy

Personal information is handled under our Privacy Policy.

21. Governing Law

These Terms are governed by the laws applicable to Oumi's Legacy in the Commonwealth of Kentucky, United States, subject to any mandatory consumer rights or other legal protections that apply.

22. Changes to These Terms

We may update these Terms from time to time. The version applicable to a transaction is generally the version available when the order or booking is submitted, unless applicable law requires otherwise.

23. Severability

If any provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

24. Entire Agreement

These Terms, together with the applicable Return & Refund Policy, Privacy Policy, product/service descriptions, Pickup Locations information, and Booking Details & Terms, form the agreement governing the relevant transaction. Where a more specific policy applies, it takes precedence for that subject, except where the law requires otherwise.
